hello,
I have overheard a few rumours from staff today that SET is being sued by the ORR due to the overrun at Etchingham 2 years ago under health and safety legislation. Has anyone else heard about this? Is it deserved?

Is it deserved? The train concerned had its sand hoppers empty on a day when low adhesion was expected. Southeastern knew a couple of days earlier that the hoppers were low on sand, and probably had information that they were actually empty, but had failed to replenish them. www.raib.gov.uk/cms_resources.cfm?file=/111117_R182011_Stonegate.pdfI can't comment on ORR action, whether the incident deserves prosecution, or could perhaps be dealt with by an Improvement Notice, or simply relying on Southeastern (and other TOCs) to have learnt the lesson from the incident and the RAIB report.
